The Coulter lawsuit comes less than a week after a federal judge granted an injunction forcing Auburn University to let white nationalist Richard Spencer speak at a planned event.

But in its free-speech lawsuit, the Berkeley College Republicans - which planned to host Coulter - called that date a "sham" meant to ensure her address was poorly attended.

Coulter tweeted this morning that a lawsuit has been filed against the university demanding an appropriate and safe venue for her appearance, which is set for this Thursday.

The lawsuit said the university has no definition of "high-profile speakers", and thus its unwritten policy can be applied any way that officials want, "resulting in the marginalization of the expression of conservative viewpoints on campus by any notable conservative speaker".

A planned speaking engagement by outspoken conservative commentator Ann Coulter has been a pretty big headache already for the University of California, Berkeley, and now the legal dispute over the appearance is headed to court.

"This Semester", he wrote additionally, "UC Berkeley has dedicated more resources-in the form of staff time, administrative attention, police resources, and cash outlay-to facilitating BCR's expressive activities than have been devoted to any other student group in memory". She also told the university that if they did not let her speak on the original date, she'd litigate.

The College Republicans content that the university "hates free speech".

The school offered to allow Coulter to appear on campus on May 2, but the student groups say in the lawsuit that the offer is not acceptable because classes are not being held next week while students prepare for finals.

"The allegation contained in the complaint filed by Young America's Foundation that Ms. Coulter is being prohibited from speaking because of her conservative views is untrue".

"It's not in writing it's not been publicized but it has been used to shut down two speakers the Berkeley College Republicans have brought to Cal", said Dhillon.

"The constitution permits the university to take such steps to protect public safety while facilitating expressive activities, and that is exactly what we are doing", Mogulof said.
