Anti-stall system active before Ethiopian 737 MAX crash

Boeing 737 plane crash: Findings out on Ethiopian Airlines disaster | Daily Star

Meanwhile, the family of Rwandan citizen Jackson Musoni, a United Nations worker who was killed in the Ethiopian crash, has filed a lawsuit against Boeing in Chicago federal court, alleging that the plane maker had defectively designed the anti-stall system.

Investigators believe it was the same system that led to a Lion Air flight to crash in Indonesia less than five months earlier.

Boeing is preparing to submit final paperwork to USA regulators for a software upgrade to the anti-stall countermeasure on the 737 MAX which investigators said in a preliminary report repeatedly pushed the nose down on the Lion Air flight.

The U.S. planemaker, working with regulators, has spent months refining the 737 Max's software since data from the Lion Air crash indicated the stall-avoidance system had repeatedly tipped the nose down before pilots lost control. If the planes would need to remain grounded throughout the busy summer season, Tui predicts the costs would rise up to €300m and annual profit would be 26% lower than previous year. "We are evaluating whether we will shift to Airbus or keep Boeing", he added.

On Thursday, a lawsuit was filed in Chicago federal court by the family of one of the victims of the Ethiopian crash, Jackson Musoni, a citizen of Rwanda. Ethiopian officials were expected to release their preliminary findings shortly.

Ethiopian Airlines Flight 302 crashed the morning of March 10 after taking off from Addis Ababa on its way to Nairobi, Kenya, killing all 157 people on board.

The European Aviation and Space Agency certified the plane as safe partly because it said additional training would "clearly explain" to pilots the "unusual" situations in which they would need to manipulate a rarely used manual wheel to control, or "trim", the plane's angle.

Boeing revealed updates to a scrutinized automated safety system in the new model on Wednesday while defending the original design, saying the software updates would make the design "more robust".

Both crashes killed a combined 346 people and are being investigated by teams of worldwide experts led by the countries where the flights originated.

After the software update is approved, it would take about a day to deploy and an hour to upgrade each aircraft.

In other words, Boeing will have some substantial liability in both crashes, and perhaps even in the costs associated with grounding the 737 Max fleet around the world.

In the Lion Air crash, the MCAS forced the plane's nose down more than 24 times before it finally hit water, according to a preliminary investigation by Indonesia's National Transportation Safety Committee, which also found the system was responding to a faulty sensor.
